In short
This website describes our services and takes inquiries. Testing work is governed by a written quotation and purchase order, not by this page, and the engineering tools here are for planning only.
01 · ACCEPTANCE
Agreeing to these terms
These Terms of Use apply to sterlingperformance.org and the pages, forms, and engineering tools on it (the “website”), operated by Sterling Performance, Inc. (“Sterling Performance,” “we,” or “us”). By using the website you agree to these terms. If you do not agree, please do not use the website.
02 · TESTING SERVICES
Quotes and testing work
Submitting a quote request or contact form is an inquiry only. It does not create a contract, reserve laboratory time, or oblige either party to proceed. Testing and engineering work is performed only under a written quotation accepted by a purchase order, or under another written agreement, and the terms of that quotation or agreement govern the work. If those terms conflict with these Terms of Use, those terms control.
Descriptions of services, capabilities, equipment, standards, and turnaround on the website are general information. They may change and are confirmed only in a quotation for a specific project.
03 · ENGINEERING TOOLS
Planning tools and sample content
The engineering tools, explorers, planners, sample reports, and similar content on the website are provided for general planning and illustration. Their outputs are estimates and examples, not test results, engineering advice, certifications, or a recommendation for any specific product or program. Do not rely on them for design, safety, compliance, or purchasing decisions. Confirm every requirement with a qualified engineer and, where testing is needed, through a quotation from Sterling Performance.
04 · YOUR SUBMISSIONS
Information and files you send
You are responsible for the information and files you submit. Only send technical, confidential, export-controlled, or third-party information that you are authorized to share. Website forms do not by themselves create a nondisclosure or confidentiality agreement; if a project needs one, contact us before sending sensitive material. You keep ownership of what you submit, and you permit us to use it to review, respond to, and follow up on your inquiry. How we handle personal information is described in our Privacy Policy.
05 · ACCEPTABLE USE
Using the website responsibly
You agree not to misuse the website. That includes submitting false, misleading, or unlawful content; sending spam or automated submissions; attempting to gain unauthorized access to the website, its systems, or the private staff areas; interfering with its security or operation; introducing malicious code; or scraping or copying the website in bulk.
06 · INTELLECTUAL PROPERTY
Content on the website
The website and its content, including text, graphics, photographs, logos, and the Sterling Performance name and marks, belong to Sterling Performance or its licensors and are protected by law. You may view and print pages for your own business evaluation of our services. You may not otherwise copy, modify, distribute, or use the content without our written permission. Accreditation and certification marks shown on the website belong to their respective owners.
07 · THIRD-PARTY LINKS
Other websites and services
The website may link to or rely on third-party websites and services, such as maps, LinkedIn, and Google reCAPTCHA. We do not control them and are not responsible for their content, availability, or practices. Their own terms and policies apply.
08 · DISCLAIMERS
No warranties
The website and its content are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components.
09 · LIMITATION OF LIABILITY
Limits on our responsibility
To the fullest extent permitted by law, Sterling Performance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from or related to your use of, or inability to use, the website or its content, even if we were advised of the possibility of those damages. This section does not limit liability under a separate quotation or agreement for testing work, which is governed by that document.
10 · GOVERNING LAW
Governing law and changes
These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law rules. Any dispute arising from them will be brought in the state or federal courts located in Michigan, and you consent to their jurisdiction.
We may update these terms from time to time. The effective date above changes when we do, and continued use of the website after an update means you accept the updated terms. If any provision is found unenforceable, the rest remain in effect.
